Mental Health and Relief From Disabilities
There are numerous categories of persons who are prohibited from possessing firearms and ammunition under both state and federal law. Among those persons who are prohibited, are those in Maryland who:
- suffer from a mental illness that so substantially impairs their mental or emotional functioning as to make care or treatment necessary or advisable for their welfare or for the safety of the person or property of another, and have a history of violent behavior against themselves or another;
- have been found incompetent to stand trial;
- have been found not criminally responsible by reason of insanity;
- have been voluntarily admitted for more than 30 consecutive days to a mental health facility;
- have been involuntarily committed to a mental health facility; or
- are under the protection of a guardian appointed by a court, except for cases in which the appointment of a guardian is solely a result of a physical disability.
The individuals who have lost their firearms rights in Maryland for any of the above reasons are entitled to apply to the Maryland Department of Health for relief from the disability they are subject to.
