Retrieving Confiscated Firearms

Pennsylvania’s Uniform Firearms Act requires the Pennsylvania State Police (PSP) and any local law enforcement agencies to make all reasonable efforts to determine the lawful owner of any firearms they confiscate or recover and return those firearms to their lawful owners if the owners are not otherwise prohibited from possessing the firearms. This may not apply if the firearms are evidence of a crime.

If the PSP or any local agencies fail to comply with these obligations, it is possible to seek a court order to force them to return the firearms, and it may be possible to recover attorney’s fees to do so.
